01Agreement to these terms
By using terraaltakc.com, contacting us for an estimate, or hiring us for work, you agree to these terms. If you do not agree, please do not use the site or engage our services.
If you have a signed proposal or contract with us, that document controls wherever it differs from this page. These terms fill in the gaps and cover your use of the website.
02Who we are
Terra Alta Construction is a residential exterior contractor serving the Kansas City metro in Kansas and Missouri. We perform concrete, roofing, gutter, painting, siding, and window work, along with related exterior repairs.
Our legal business name is [LEGAL ENTITY NAME — e.g. Terra Alta Construction LLC], with a business address at [STREET ADDRESS, CITY, STATE ZIP]. We carry general liability and workers' compensation coverage, and we will provide certificates of insurance on request before work begins. Municipal contractor licensing and registration is held where the work requires it.
03Estimates and proposals
- Estimates are free and carry no obligation. We walk the property, measure, and leave you a written line-item proposal.
- A proposal is an offer, not a contract. It becomes binding when you accept it in writing and we countersign it.
- Unless the proposal says otherwise, pricing is held for 30 days. Material costs move, and after 30 days we may need to re-quote.
- Verbal quotes, ballpark ranges, and numbers given over the phone or in chat are estimates only. Only a written proposal is a price.
- Any allowance stated in a proposal is a budget placeholder. If your final selection costs more, the difference is added by change order.
04Scope of work and change orders
We perform the work described in your signed proposal, using the materials it names or their equivalent if a product is discontinued or unavailable.
Anything added to, removed from, or substituted in that scope is handled by a written change order describing the work and the price adjustment. We will not perform extra billable work without your approval, and we ask that you not direct our crew to do so informally.
Small variations in color, texture, and finish are normal. Concrete cures to slightly different shades, stained and painted surfaces vary with substrate and light, and manufactured materials vary between production runs. These variations are not defects.
05Scheduling, weather and delays
- Most projects are scheduled within two to four weeks of a signed proposal, weather permitting. Emergency repairs such as active leaks and storm damage are prioritized.
- All dates are estimates. Exterior work depends on weather, and we will not pour, roof, or paint in conditions that would compromise the result.
- We may reschedule for rain, wind, temperature, freeze, material back-order, permit timing, or safety. We will tell you as soon as we know.
- Delays outside our reasonable control — weather, supply shortages, labor disruption, utility or municipal delays, or acts of God — do not put us in breach.
- Our normal working hours are Monday through Saturday, 7am to 6pm.
06Payment
- Payment terms, including any deposit and the schedule of progress payments, are stated in your proposal.
- Final payment is due on substantial completion, which means the work is finished and usable, even if minor punch-list items remain.
- We accept the payment methods listed on your invoice. Card payments may carry a processing fee if the invoice says so.
- Past-due balances may accrue interest at [RATE, e.g. 1.5% per month], and you are responsible for reasonable collection and attorney costs on amounts properly owed.
- We reserve all lien rights available under Kansas and Missouri law for work performed and materials supplied.
07Warranty
Our workmanship warranty
We warrant our labor against defects in workmanship for [WARRANTY TERM — e.g. 1 year / 2 years / 5 years] from substantial completion. If something we installed fails because of how we installed it, we will repair it at no charge. The exact term for your job is stated in your proposal.
Manufacturer warranties
Shingles, siding, windows, coatings, and other products carry warranties from their manufacturers. Those are separate from ours, run directly between you and the manufacturer, and we will register them and hand you the paperwork.
What the warranty does not cover
- Damage from storms, hail, wind, fire, falling limbs, vandalism, or accident.
- Damage from settlement, ground movement, tree roots, or water intrusion originating outside our scope.
- Work altered, repaired, or added to by anyone else.
- Failure to perform normal maintenance, including keeping gutters clear and sealing concrete where recommended.
- Normal wear, fading, and weathering, and the ordinary variations described in section 4.
- Hairline cracking in concrete. Concrete moves as it cures and as the ground freezes and thaws. Properly placed control joints direct that movement; they do not eliminate it.
- Pre-existing conditions we identified and noted, or work you directed us to perform over our written recommendation.
Warranty coverage requires that your account be paid in full.
08Permits, codes and inspections
Where a permit is required, we pull it and schedule the inspections unless your proposal says otherwise. Permit fees are either included in your proposal or billed at cost, and the proposal will say which.
We build to the code in force in your municipality. If an inspector requires work beyond the agreed scope, we will document it and issue a change order.
09Insurance claims and storm work
We document damage, meet your adjuster on site, and help make sure the approved scope reflects what the house actually needs. We work for you, not for your insurance company.
Deductibles. Kansas and Missouri law prohibit a contractor from paying, waiving, rebating, or absorbing any part of a property insurance deductible, and from advertising that they will. We will not do it, and you should be cautious of any contractor who offers to.
We do not provide public adjusting services, and we do not negotiate your claim on your behalf or give legal advice about your policy. Decisions about your claim are yours to make with your carrier.
10What we need from you
- Clear access to the work area during working hours, including driveway access for trucks, dumpsters, and material drops.
- Vehicles moved out of the driveway and off the affected area before we start.
- Fragile items taken down from interior walls before roofing or siding work. Hammering vibrates a house.
- Pets kept safely inside and away from open gates, tools, and fresh concrete.
- Patio furniture, planters, grills, and decorations moved clear of the work area.
- Private utilities marked — irrigation lines, invisible fencing, landscape lighting, septic. We call in public utility locates, but private lines are not covered by that service and we cannot be responsible for unmarked ones.
- Working power and water access where the job requires it.
We protect landscaping, sweep with a magnet at the end of each day, and leave the site clean. Some disturbance to grass and beds adjacent to the work is unavoidable on exterior projects.
12Your right to cancel
If you sign a contract with us at your home rather than at a place of business, federal law gives you the right to cancel within three business days without penalty. Your proposal includes a written notice of cancellation explaining how.
If you cancel after that window, you are responsible for materials already special-ordered or fabricated for your job and for work already performed, as described in your proposal.
We may cancel a project if the site is unsafe, if conditions differ materially from what was quoted and we cannot agree on a change order, or if payment terms are not met. In that case you owe us for work completed to date.
13Limitation of liability
We stand behind our work, and we carry insurance for exactly this reason. That said, to the fullest extent permitted by law:
- Our total liability arising out of a project is limited to the amount you paid us for that project.
- We are not liable for indirect, incidental, or consequential damages, including lost income, loss of use, or damage to personal property that was not moved clear of the work area after we asked.
- Nothing here limits liability that cannot be limited by law, including liability for bodily injury caused by our negligence.
14Using this website
The content on this site — text, layout, photography, logos, and the Terra Alta name and mark — belongs to us or our licensors. You may view and share it, but not copy it for commercial use without permission.
Project photography on this site includes representative imagery of the type of work we perform. It illustrates materials, styles, and finishes rather than serving as a catalog of specific completed addresses.

16Governing law and disputes
These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. For work performed in Missouri, Missouri law governs that work where it must.
If something goes wrong, call us first. Most issues are solved with a conversation and a return visit. If we cannot resolve it, the parties agree to attempt good-faith negotiation, then mediation, before filing suit. Any action that does proceed will be brought in the state courts located in [COUNTY, e.g. Johnson County, Kansas], and both parties consent to that venue.
17Changes to these terms
We may update these terms. The version posted here at the time you sign a proposal is the version that applies to that job. Continued use of the website after we post changes means you accept the updated terms.
If any provision here is found unenforceable, the rest stays in effect.
